Job Description:
Our team is expanding, and our National Claims team is actively seeking to hire a Litigation Specialist, Casualty Claims Bodily Injury for our National Bodily Injury team. Reporting to the Bodily Injury claims manager, in this role, you will be responsible for the full handling of litigation claims with an emphasis on timely and fair resolution.
Accountabilities :
-
Investigate and settle litigation files of various complexity.
-
Directs and guides activities of defence counsel, to bring cases to optimum & timely resolution.
-
Interprets complex insurance wordings/case law, determines policy coverages, and establishes reserves.
-
Review and assess reports from defence counsel, approves settlements and process payments within established authorization limits or approval of management.
-
Attends private mediations, settlement meetings, hearings, etc. as required.
-
Provide input into the development of tactics relating to regional cost containment strategies.
-
Identify & understand emerging trends and problems with consideration given to multiple variables, i.e., legislations, interpretations, impacts severity initiatives to improve results.

Mentor and coach junior claim staff as required.
Qualifications:

Minimum 5 years of strong insurance background in a Bodily Injury claim environment.

Advanced knowledge of claim handling of Bodily Injury claims.

Advanced file settlement/resolution skills.
-
Enrolled in, or completion of, CIP designation.
-
Excellent communication skills.

University degree/college diploma or equivalent work experience

Notre unité nationale des réclamations, en plein essor, est à la recherche d’un ou d’une spécialiste en litiges, réclamations accidents (dommages corporels) qui se joindra à notre équipe nationale des dommages corporels. Relevant du directeur ou de la directrice, réclamations accidents (litiges), la personne titulaire de ce poste sera responsable de la prise en charge intégrale des dossiers litigieux liés à des réclamations, et veillera à ce qu’ils soient réglés de façon juste, dans des délais raisonnables.
Responsabilités :

Enquêter sur des dossiers litigieux liés à des sinistres dont la complexité peut varier, et les régler;

Orienter et conseiller l’avocat de la défense en vue d’un règlement optimal et rapide;

Interpréter les libellés de contrats complexes et la jurisprudence et déterminer les garanties de police applicables et les provisions;
-
Examiner et évaluer les rapports de l’avocat de la défense, approuver les règlements et traiter les paiements établis dans les limites prescrites par la direction;

Assister à séances privées de médiation, des réunions de règlement, des procès, etc., au besoin.

Donner son avis dans le cadre d’élaboration de stratégies régionales pour la limitation des coûts;

Déterminer et comprendre les nouvelles tendances et les nouveaux problèmes en tenant compte de plusieurs variables, p. ex., les lois, les interprétations, etc.;

Offrir du mentorat et de l’encadrement au personnel des réclamations moins expérimenté, au besoin.
Exigences :

Au moins cinq années d’expérience solide dans un environnement de traitement de dossiers litigieux de réclamations pour dommages corporels.

Déterminer et comprendre les nouvelles tendances et les nouveaux problèmes en tenant compte de plusieurs variables, p. ex., les lois, les interprétations, etc.;

Offrir du mentorat et de l’encadrement au personnel des réclamations moins expérimenté, au besoin.
Exigences :
-
Au moins cinq années d’expérience solide dans un environnement de traitement de dossiers litigieux de réclamations pour dommages corporels.

Habiletés pour la négociation, et la résolution de dossiers sans retard injustifié.

Capacité d’évaluer rapidement les situations et les risques, de traiter efficacement avec des parties prenantes et d’aider les autres à s’entendre sur des ententes et des règlements satisfaisant à toutes les parties.

Excellentes aptitudes pour la communication;

Diplôme universitaire ou collégial ou une expérience professionnelle équivalente;

Bilinguisme (français, anglais), un atout.
